Fair Usage and Acceptable Use Policy

Mallary helps users publish to connected social media accounts through our dashboard, API, MCP server, and CLI. This Fair Usage and Acceptable Use Policy explains the activity we do not allow and the actions we may take to protect Mallary, our users, and our access to third-party social media platforms.

This policy is part of our Terms of Service. By using Mallary, you agree to use the Service responsibly, comply with all connected platform rules, and avoid activity that creates risk for Mallary or other users.

1. Responsible Use

You are responsible for the content you create, upload, schedule, publish, automate, or submit through Mallary. You must have the right to publish the content and must comply with applicable laws, our Terms, this policy, and the terms, developer policies, content policies, and community standards of each connected social media platform.

2. Prohibited Uses

You may not use Mallary to:

  • Send spam, scams, phishing content, deceptive promotions, or unwanted repetitive posts.
  • Publish unlawful, harmful, abusive, harassing, hateful, defamatory, obscene, or otherwise objectionable content.
  • Promote fraud, impersonation, credential theft, malware, evasion, or other harmful activity.
  • Post content that infringes intellectual property, privacy, publicity, or other third-party rights.
  • Misrepresent your identity, business, product, offer, or relationship with a platform or person.
  • Use Mallary to manipulate engagement, platform algorithms, ranking systems, reviews, followers, comments, or metrics.
  • Use automation in a way that violates a social media platform's rules or creates provider-risk behavior for Mallary.
  • Attempt to bypass Mallary limits, safety controls, review flows, account restrictions, or platform restrictions.
  • Resell or expose Mallary access in a way that lets third parties post without appropriate authorization, consent, or compliance controls.

3. Fair Usage Limits

Mallary may apply fair usage limits to protect service reliability and platform access. These limits may include posting volume, posting velocity, duplicate or near-duplicate content, API usage, media uploads, connected-platform activity, and platform-specific publishing behavior.

During the first 14 days after signup, Mallary may limit posting to one post request every 10 minutes. This trial-period throttle applies across the dashboard, API, MCP server, and CLI. If Stripe reports that your paid subscription is active before the 14-day period ends, this trial-period throttle no longer applies. If you try to post again before the 10-minute period has passed while the throttle applies, Mallary may reject the request and tell you how long to wait before posting again.

Some limits may be internal and may change over time based on plan type, account history, trust signals, provider requirements, abuse patterns, and system health. Published plan limits describe normal included usage, but they do not permit abusive, harmful, or provider-risk activity.

4. API, MCP, CLI, and Third-Party Integrations

If you use Mallary through the API, MCP server, CLI, or your own application, you are responsible for ensuring that every end user has authorized the connected account being used and that your integration includes appropriate consent, authentication, rate control, and abuse-prevention measures.

You may not use Mallary as a pass-through for spam, mass automation, unauthorized posting, misleading customer workflows, or activity that would violate platform rules if performed directly on the platform.

5. Monitoring and Safety Controls

We may monitor usage patterns, post metadata, posting outcomes, platform errors, duplicate content signals, policy-risk signals, API activity, and connected-platform health to detect abuse, protect platform access, enforce this policy, and maintain service reliability.

We may use automated systems and manual review to identify high-risk activity. These systems are intended to reduce provider-level risk and protect legitimate users from service-wide platform disruption.

6. Enforcement

If we believe activity violates this policy, creates provider risk, or threatens service reliability, we may take action with or without prior notice. Actions may include warnings, rate limits, temporary posting delays, manual review, rejected posts, disabled features, API key suspension, platform-specific posting pauses, account suspension, account termination, or reporting activity to a platform or authority when required.

We may also restrict one platform, one API key, one profile, one user, or a broader service surface when needed to protect Mallary or other users.

7. Platform Provider Requirements

Mallary depends on third-party platform APIs. If a platform changes its requirements, flags activity, limits access, or asks us to take action, we may adjust limits, disable features, require reconnection, request additional information, or restrict publishing to that platform.

8. Appeals and Questions

If you believe your account or activity was restricted in error, contact us at [email protected]. Include your account email, the affected platform, and any relevant post or API details.

9. Changes to This Policy

We may update this policy from time to time. We will post the updated policy on our website and update the "Last Updated" date. Continued use of Mallary after changes constitutes acceptance of the updated policy.
